Terms of service
These Terms of Service govern the general conditions for accessing and using the website available at www.pdpaola.com and the PDPAOLA app (collectively, the “Platform”), which SASMAT RETAIL S.L. (hereinafter referred to as “PDPAOLA”) makes available to internet users.
Using the Platform implies full and unreserved acceptance of each and every provision included in these Terms of Service. Consequently, the user must carefully read these Terms of Service each time they intend to use the
Platform, as the text may be modified at the discretion of the Platform owner, or due to changes in legislation, case law, or business practices.
The language used by the owner on the Platform is Spanish, English, French, German or Italian. PDPAOLA is not responsible for the user’s lack of comprehension of the Platform’s language or any consequences thereof.

2. INTELLECTUAL PROPERTY
PDPAOLA owns all industrial and intellectual property rights over the Platform, as well as over the content hosted on it. Any use of the Platform or its contents must be strictly personal.
Any other use—such as copying, reproducing, distributing, transforming, public communication, or any similar ac- tion affecting all or part of the contents of the Platform—is exclusively reserved to PDPAOLA. No user may carry out these actions without PDPAOLA’s prior written authorization.
2. ACCESS, USE, AND CONTENT OF THE PLATFORM

The Platform provides users with access to information and services offered by PDPAOLA to individuals or organiza- tions interested in them.
Access to the Platform is free of charge for users.
As a general rule, accessing and using the Platform does not require prior subscription or user registration.
By placing an order through this website, you declare that you are over 18 years of age and have the legal capacity to enter into contracts.
2. PLATFORM CONTENT
PDPAOLA may modify the contents without prior notice, as well as remove or change them within the Platform—in- cluding the way in which they are accessed—freely and without justification, and assumes no responsibility for any consequences such changes may cause users.
Use of the Platform’s content to promote, contract, or disseminate advertising or information—your own or that of third parties—without PDPAOLA’s authorization is prohibited. You may not send advertising or information using the services or information made available to users, whether such use is free or paid.
Links or hyperlinks that third parties include on their web pages directing users to this website or app must open the full website or app; they may not make, directly or indirectly, false, inaccurate, or confusing statements, nor engage in unfair or unlawful actions against PDPAOLA.
3. PRICES AND PAYMENTS
1. PRICES
Discount codes cannot be combined and do not apply to items on sale, promotion or Fine Jewelry collections. PDPAOLA reserves the right to modify its prices at any time, while guaranteeing the buyer the application of the
price in effect at the time the order is confirmed. PDPAOLA is not obliged to compensate the customer after the time of purchase.
Prices in euros (€) include VAT for sales within the European Union.
Prices are shown in the customer’s local currency. If prices on pdpaola.com are displayed in a currency different from the user’s country, the user can change the country selection at the bottom left of the website or at the top left of the app. Prices will update automatically.
All discount percentages communicated in our promotions refer to euro prices. Discount percentages may vary when currency conversions are applied.
Sales to countries outside the European Union do not include VAT but may be subject to duties and taxes. The customer may prepay such duties and taxes during checkout or choose to pay them upon delivery.
All taxes, duties, and customs charges are the customer’s responsibility under applicable law. The amount of these charges varies by country and the total invoice amount in euros. Such charges are payable by the customer upon receipt of the order.
2. PAYMENTS & SECURITY
PDPAOLA offers several payment methods. All methods are secure and encrypted. PDPAOLA cannot view or store
the customer’s payment information.
Available online payment methods are shown during checkout.
These methods also ensure that no unauthorized party can use the data, as they rely on protected algorithms that transmit encrypted information, visible only to banking institutions.
3. PRICE ERROR CORRECTIONS
We strive to ensure that all information, including pricing, is accurate and up to date on the Platform.
However, unintentional pricing errors may occur. If a product is listed at a manifestly incorrect price—i.e., there is a significant discrepancy between a reasonable price and the sale price shown on the Platform due to a typographical error, transcription error, incorrect pricing information from our suppliers, technological or computer errors, or any other error in the price displayed to the customer—PDPAOLA reserves the right to refuse the order and to cancel or request the return of any order placed for products listed at the manifestly incorrect price.

If your order has been confirmed and your credit card charged, we will issue a credit for the amount of the incorrect price and cancel your order. If the correct price of the product is higher than the listed price, we will contact you to offer the option to proceed with the order at the correct price or cancel your order.

If the product has already been delivered at a manifestly incorrect price, we reserve the right to request the product’s return or, alternatively, offer you the option to pay the difference between the incorrect price and the correct price. We will contact you to coordinate the return or additional payment.
This policy applies regardless of whether the order has been confirmed, payment has been processed, or the product has been delivered. We apologize for any inconvenience and appreciate your understanding.
4. SHIPPING AND DELIVERY
1. COUNTRIES, DELIVERY METHODS, AND SHIPPING FEES
You can view here the list of countries we ship to on the Platform.
Depending on the delivery country, different shipping methods and delivery times are available, each with different
shipping fees.
2. PREPARATION TIMES
All orders are prepared within 48 hours after the order confirmation email is sent to the customer.
If the customer believes their order is delayed, they can contact our Customer Care team through the contact form. Order preparation is fast, so we cannot guarantee any requested changes to the order.
Orders containing fine jewelry items have specific preparation times communicated during checkout.
PDPAOLA is not responsible for external factors that may delay or prevent delivery and are outside the control of our logistics partners.
3. SHIPPING & ORDER TRACKING
As soon as we ship your order, you will receive a confirmation email with a link to track the shipment.
If the customer is not at the delivery address at the time of delivery, the carrier will contact them to reschedule a second delivery attempt.
During sales and promotional periods (such as Black Friday, Cyber Monday, and Christmas), carriers may expe- rience slight delivery delays. Any update to your shipment status will be notified, and you will have access to full tracking information once your order has shipped. If you identify any issue, please contact us.
4. CUSTOMS FEES
Shipments to countries outside the European Union may occasionally incur additional taxes and duties, which will in all cases be the customer’s responsibility.
PDPAOLA undertakes to carry out the necessary steps and prepare the required documentation for the correspon- ding customs process.
5. RIGHT OF WITHDRAWAL, EXCHANGES, AND RETURNS
1. RIGHT OF WITHDRAWAL
The customer has the right to withdraw from this contract within 14 calendar days without giving any reason.
The withdrawal period will expire 14 calendar days from the date on which the customer or a third party indicated by the customer, other than the carrier, acquired physical possession of the goods.
To exercise the right of withdrawal, the customer must notify PDPAOLA Customer Care at Plaça d’Emili Mira i Lopez 4, 08022, Barcelona, Spain, by phone at +34 937 609 481, or by email at [email protected] of their decision to withdraw from the contract by means of an unequivocal statement (e.g., a letter sent by post or email). The model withdrawal form included in the annex to these terms may be used, though it is not mandatory.
To meet the withdrawal deadline, it is sufficient for the customer to send their communication concerning the exerci- se of the right of withdrawal before the withdrawal period has expired.
2. EFFECTS OF WITHDRAWAL
If the customer withdraws, we will reimburse all payments received from them, including delivery costs (except for any additional costs resulting from their choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of the decision to withdraw from this contract. We will carry out the reimbursement using the same means of payment used for the initial transaction, unless the customer has expressly agreed otherwise; in any event, the customer will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back, or until the customer has supplied eviden- ce of having sent back the goods, whichever is the earliest.
The customer must send the goods back without undue delay and in any event no later than 14 calendar days from the date on which they communicate their withdrawal from the contract. The deadline is met if the customer sends back the goods before the 14-day period has expired.
Unless you return the goods at an authorized drop-off point, you must bear the direct cost of returning the goods.
The customer is only liable for any diminished value of the goods resulting from handling other than what is neces- sary to establish the nature, characteristics, and functioning of the goods.
3. GENERAL CONDITIONS FOR WITHDRAWAL, EXCHANGES, AND RETURNS
Voluntary return guarantee in addition to your legal right of withdrawal
Without prejudice to the legally recognized right of withdrawal as set out above, we additionally offer a 30-day pe- riod from the date the customer or a third party indicated by the customer, other than the carrier, acquires physical possession of the goods.
Exceptions to the right of withdrawal
The customer will not have the right to withdraw from the contract or to make exchanges or returns when the contract concerns products made to the customer’s specifications or clearly personalized to their personal needs (personalized products).
The right of withdrawal, as well as exchanges and returns, will only be valid if the product is returned in the same condition in which it was received. Exchanges, returns, or refunds will not be accepted if the product has been used beyond opening, shows damage, or is not in its original condition.
To proceed with a return, the item must include its original packaging, tags, associated gifts, instructions, and any additional accompanying documents. Products must arrive in perfect condition, with no obvious signs of use and in their original packaging; otherwise, the request will be rejected.
It is the customer’s responsibility to provide adequate packaging so that the items arrive at PDPAOLA in perfect condition. If items are received in poor condition, we will be unable to process the return.
Refund conditions
Refund conditions deriving from the right of withdrawal are set out in Section 5.2. Effects of withdrawal. Refund conditions for the voluntary return guarantee are as follows.
After the product is received at our facilities, our quality team will review the items and process the request within a maximum of 14 business days.
PDPAOLA is not responsible for any loss the package may suffer during shipping. It is the customer’s responsibility
to ensure that the package reaches our facilities in perfect condition.
If everything is in order, the refund will be processed using the same payment method used during checkout. De- pending on each bank’s processing times and the payment method selected, the refund may take up to 30 days to appear in your account.
Products purchased during promotional periods will be refunded according to the conditions of the relevant promo- tion. If a partial or full return invalidates the promotion under which the purchase was made, PDPAOLA reserves the right to:

Process the refund by recalculating the order discounts based on the conditions in effect at the time of pur- chase.
4. EXCHANGES AND RETURNS THROUGH THE PLATFORM
To return or exchange an item, the customer must submit a request through the Returns Center available on the Platform.
If you cannot register your request, please contact our Customer Care team by completing the form.
We accept requests within 24–48 hours. After that period, the customer will receive instructions by email. Return and exchange conditions depend on the destination country.
In general, PDPAOLA offers the following return and refund options:
Refund to original payment method

Home pickup: A courier will collect the package from the address provided by the customer. This service carries a fee of €4.95 per request, which will be deducted from the total refund amount.

Drop-off at an authorized location: The customer may drop off the package at one of our authorized drop-off
points. This service carries a fee of €2.95 per request, which will be deducted from the total refund amount.
Store credit

Home pickup: A courier will collect the package from the address provided by the customer. This service carries a fee of €2.95 per request, which will be deducted from the total store credit amount.

Drop-off at an authorized location: The customer may drop off the package at one of our authorized drop-off
points. This option is completely free of charge.
The customer may select the preferred return method when starting their request through our returns portal.
6. WARRANTY
PDPAOLA covers non-conformity of purchased products for a period of 3 years from the delivery date.
This warranty applies exclusively to pieces manufactured by PDPAOLA and purchased through authorized sales channels.
The warranty covers defects in materials and/or workmanship. In the event of such defects, PDPAOLA will repair or
replace the affected product.
This warranty does not cover:

Damage resulting from misuse, physical abuse, or accidental damage by the consumer.

Normal wear and tear from product use.

Natural variations in materials such as stones or pearls, which may present inherent inconsistencies and are not considered defects.
To benefit from the warranty, the customer must contact us through our Warranty Claim Centre; our Customer Care team will respond to the request.
7. DATA PROTECTION
In accordance with the General Data Protection Regulation, users may exercise their rights of access, rectification,
deletion/extraction, objection, restriction, or portability.

8. GIFT CARD TERMS
1. PURCHASE
PDPAOLA Gift Cards and e-gift cards are available for purchase exclusively on our website, at any PDPAOLA store (excluding outlet locations), and at franchised stores.
You can choose the Gift Card amount on its product page: from €50 to €950. It can only be used to purchase PDPAOLA products.
It is not possible to reload your PDPAOLA Gift Card once it has been used.
The Gift Card can be paid for using any payment methods accepted on the Platform or at PDPAOLA stores. A Gift Card cannot be paid for with another Gift Card, discount codes, or other promotional discounts.
The PDPAOLA Gift Card is digital and will be sent by email to the address provided. No physical Gift Card can be sent to any postal address.
Important:
Gift Card purchasers and users must ensure they provide the correct email address.
Recipients are responsible for retaining the Gift Card email; we cannot issue a new one if the Gift Card email is dele- ted from their inbox.
You can purchase more than one Gift Card per order by choosing “add to cart” or repeating the “send as a gift” option for as many recipients as you wish. Each recipient will receive a unique Gift Card code by email; it will not be visible in the buyer’s order confirmation or to any other recipient.
The Gift Card code is emailed to the recipient on the date selected by the buyer on the Gift Card product page,
which may differ from the purchase date.
The Gift Card is activated on the selected date.
2. USE AND VALIDITY (TIME & LOCATION)
PDPAOLA Gift Cards purchased on the website may only be redeemed on the website of the country in which they were purchased. If the Gift Card was purchased on the Spanish website or at a PDPAOLA store in Spain (excluding outlet locations), it may be redeemed both on the Spanish website and at PDPAOLA stores in Spain. Outlet loca- tions, franchised stores, department stores (such as El Corte Inglés, Coin, and Printemps), and any other third-party points of sale are expressly excluded.
PDPAOLA Gift Cards purchased at PDPAOLA stores outside of Spain may only be redeemed at PDPAOLA stores in the same country in which they were purchased. Outlet locations, franchised stores, department stores (such as El Corte Inglés, Coin, and Printemps), and any other third-party points of sale are expressly excluded.
PDPAOLA Gift Cards purchased at franchised stores may only be redeemed at the franchised store where they were purchased, or at other franchised stores operated by the same franchisee within the same country.
The PDPAOLA Gift Card can only be redeemed in euros (€).
To redeem a Gift Card, enter the code received by email during checkout in the “Order Summary” section.
The Gift Card can be used as many times as desired until the balance is exhausted. If the purchase exceeds the value of the card, the remaining amount can be paid using another available payment method.
Only one Gift Card may be used per purchase. However, it can be combined with a discount code and other pay-
ment methods offered at checkout.
The Gift Card balance can be checked at any time by clicking the link included in the Gift Card email. The PDPAOLA Gift Card expires 365 days after the email receipt date.
The PDPAOLA Gift Card can be purchased and redeemed in the following countries:
Germany, Austria, Bangladesh, Belgium, Cyprus, Slovakia, Slovenia, Mainland Spain and Balearic Islands, Estonia, Finland, France, Greenland, Equatorial Guinea, Guinea-Bissau, Haiti, Iraq, British Virgin Islands, Italy, Jersey, Latvia, Lithuania, Luxembourg, Mauritius, Monaco, Montenegro, New Zealand, Portugal, Singapore.
3. SPECIAL CONDITIONS FOR EXCHANGES AND RETURNS
The Gift Card is an electronic product whose primary purpose is to be used as a payment method. Therefore, the Gift Card is not subject to the voluntary return guarantee in addition to your legal right of withdrawal specified in Section 5.3. General conditions for withdrawal, exchanges, and returns.
Products purchased with a Gift Card may be exchanged for other products or returned. In case of return, the amount will be refunded exclusively via a new Gift Card, not by credit card or any other payment method.
If the customer decides to return an item partially paid with a Gift Card, the amount paid via the Gift Card will be cre- dited to a new card, and not by any other means. Any amount paid via another payment method will be refunded to that same method.
4. PRIVACY
To process the purchase of a Gift Card, certain personal data are required, such as: First Name, Last Name, and email address.
This data will only be used for managing the electronic Gift Card and will not be retained for any other purpose.
5. LIABILITY
The issuer and owner of the Gift Card is PDPAOLA. The Gift Card is a bearer instrument. Responsibility for its use and safekeeping lies solely with its holder or recipient.
The recipient is solely responsible for the use and safekeeping of the Gift Card. PDPAOLA is not responsible for the loss or deletion of the Gift Card email; no refund will be made, nor will a new card be issued.
Presentation of the purchase receipt by the buyer does not entitle them to any refund or to the issuance of a new Gift Card.
Unless previously authorized in writing by PDPAOLA, the Gift Card may not be used for advertising or promotional purposes for products or services marketed by third parties unrelated to PDPAOLA.
If you purchase a Gift Card, PDPAOLA is not responsible for the recipient’s non-receipt or delayed receipt due to causes beyond PDPAOLA’s control, such as telecommunications failures, data loss, inaccurate recipient information, inability to deliver the card to the email account provided by the buyer, or the email being routed to spam.
This Notice will be interpreted and governed in accordance with Spanish law. PDPAOLA and the users, expressly waiving any other jurisdiction that may correspond to them, submit to the courts and tribunals of the user’s domicile for any dispute that may arise from access to or use of the Platform. If the user’s domicile is outside Spain, PDPAO- LA and the user submit, with express waiver of any other jurisdiction, to the courts and tribunals of Barcelona.
9. LIABILITY AND JURISDICTION
Both access to the Platform and any unauthorized use of the information contained therein are the sole responsibi- lity of the person performing such actions. PDPAOLA will not be liable for any consequences, damage, or harm that may result from such access or use. PDPAOLA is not responsible for security errors or damage that may be caused to the user’s computer system (hardware and software), or to files or documents stored therein, as a consequence of:

The presence of a virus on the user’s device used to connect to the Platform’s services and content.

A malfunction of the browser.

And/or the use of outdated versions of the browser or app.
PDPAOLA is not responsible for the reliability or speed of hyperlinks included on the Platform to open other websi- tes. PDPAOLA does not guarantee the usefulness of these links and is not responsible for the content or services that the user may access through them, nor for the proper functioning of those websites.
PDPAOLA will not be responsible for viruses or other computer programs that may damage or could damage users’ systems or computer equipment when accessing its Platform or other websites accessed through links from this Platform.
