This Notice regulates the General Conditions of access and use of the website accessible through www.pdpaola.com (henceforth, the website), which SASMAT RETAIL S.L. makes available to internet users.

The use of the website implies the complete acceptance without reservations of each and every resolution included in this Notice. Therefore, the user must read the current legal notice carefully every time the website is accessed, as the terms of use are subject to modifications on the judgement of the website's owner, or due to legal, judicial criterion or business practice changes.

The language used by the owner of this website is Spanish. SASMAT RETAIL S.L. cannot be held responsible for the user's misunderstanding or comprehension of the language of the website, nor for its consequences.

All rights on industrial and intellectual property of the website, as well as all content in it, are property of SASMAT RETAIL S.L.. Any use of the website or its content must be exclusively for particular purposes.

It is exclusively reserved for SASMAT RETAIL S.L., any other use involving copying, reproduction, distribution, transformation, public communication or any other similar action, of part or the whole of the content of the website, and thus no user will be allowed to carry out these actions without prior written authorization from SASMAT RETAIL S.L.

 

2. ACESS, USE & CONTENT

2.1. ACCESS & USE

The website allows its users access to information and services offered by SASMAT RETAIL S.L. to those people and organizations interested in them.

Free access and use of the website. The access and use of this website is free for its users.

User registration. The access and use of the website do not demand prior subscription or registration of its users.

2.2. CONTENT

SASMAT RETAIL S.L. is allowed to modify the contents without notice, just as eliminate or changed them within the website, as well as its access, freely and without justification, not being responsible for the consequences that may cause to the users.

The use of the website content to advertise, hire or spread advertising, or own information or of third parties without the authorization of SASMAT RETAIL S.L., or forward advertising of information, through the services or information available to the users, regardless its use being free or not.

Links and hyperlinks added by third parties in their websites, addressing the website, will redirect to the website, not being able to demonstrate, directly or indirectly, false, inaccurate or confuse indications, nor engaging disloyal or illicit actions against SASMAT RETAIL S.L

 

3. PRICES & PAYMENTS

3.1. PRICES

Discount codes cannot be combined with each other, and do not apply to products on sale or on promotion.

PDPAOLA reserves the right to modify its prices at any time as long as we guarantee to the buyer the application of the current price at the moment of the order confirmation. PDPAOLA will not be obliged to compensate the customer after the date of purchase.

Prices in euro (€) include VAT for sales within the European Union.

The prices are shown in the customer local currency. If the customer lands on pdpaola.com on another country's currency, they can change the country at the bottom left of the website and prices will automatically update.

All discount percentages communicated in our promotions refer to prices in euros. The discount percentages may vary when applying the necessary currency exchanges.

Sales to countries outside the European Union do not include VAT, however, they're subjects to possible Tax and Duties.
The customer can prepay those Tax and Duties during the checkout process, or chose to pay them upon delivery.

All taxes, tariffs and customs duties are borne by the customer according to the legal provisions in force. The amount of those taxes varies according to the country and to the total invoice amount in euros. Those taxes are borne by the customer when receiving his/her order.


3.2. PAYMENTS & SECURITY

PDPAOLA offers several payment methods to the customer. All those methods are secured encrypted. SASMAT RETAIL SL cannot see, nor stock the customer's information.

The online payment methods offered are shown during the checkout process.
Those methods also ensure that no piece of information can be used by any disinterested party, as they are based on protected algorithms, transmitting encrypted information, so that it is only visible for bank entities.

 


4. SHIPPING & DELIVERY

4.1. SHIPPING COUNTRIES, METHODS & PRICES

The countries we ship to are available for consultation on this link.
Depending on the country, several shipping methods and delivery times are proposed to customers with different shipping prices.

4.2. PREPARATION TIME

All orders are prepared within 24h after the order confirmation date.

Orders are prepared quickly, and so, changes upon customer request cannot be guaranteed.
However, the customer can contact our Customer Service team, who will do its best to accommodate the customer's request.

Fine Jewelry has a specific preparation time, which is indicated during the purchase process.

PDPAOLA cannot be held responsible for external factors which may delay or prevent a delivery, and which are not covered by our logistic partners.


4.3. SHIPPING & TRACKING

As soon as an order is dispatched, a confirmation email is sent, from which the customer can track their order.
The customer can also track their order on the dedicated “Order Status” section of the website.

In the event that the customer is not at the shipping address upon delivery, the courier company will contact them in order to reschedule a second delivery attempt.

During peak seasons (like Black Friday, Cyber Monday or Christmas), courier companies may experience a slight delay in delivery. Every status update will be notified to you, and you will have access to all tracking information once your order is dispatched from our warehouse. If you notice any transportation issues, please get in touch with us for assistance.

 

4.4. CUSTOM TAXES

Shipments to non-European Union countries may be liable for customs taxes and additional fees. In all cases, these costs will be the responsibility of the buyer and will be settled at the given customs office.
PDPAOLA is committed to taking care of all the required paperwork in order for the parcel to clear customs.

 

5. EXCHANGES & RETURNS

PDPAOLA accepts returns and exchanges up to 30 days after the delivery date.

To return and exchange an item, the customer has to enter their request via our Return Center.
The request will be accepted within 24-48 hours. The customer will then receive all the instructions to follow by email.

Return and exchange conditions depend on the country of origin.
The specificities of each region are detailed in our Refund Policy.

Products purchased during sales or promotion campaigns will be refunded according to the conditions of the campaign. If the partial or total return of an order invalidates the promotion under which the purchase was made, PDPAOLA reserves the right to:

  • Demand the return of promotional products.
  • Make the refund by recalculating the discounts of the order applying the conditions in force at the time of making the purchase.

 
Return conditions & packaging:

It is essential that the products to be returned are in perfect condition, without any obvious signs of use; if not, no return may be accepted.

It is the customer's responsibility to provide suitable packaging to ensure that the articles reach PDPAOLA in perfect condition.
If the items are received in poor condition, the return may not be processed.

 

 

6. WARRANTY

All of our jewelry has a 3-year quality warranty, starting from the delivery date of the order.
The warranty is valid against any material and/or manufacturing defect. This warranty does not include insurance against physical or accidental wear and/or damage.
To benefit from our warranty, the customer has to fill our Warranty Claim form on our Return Center, and our Customer Service team will get back to them by email.

 

7. CUSTOMER SERVICE

In compliance with the provisions of the General Register of Data Protection, the user will be eligible to pursue his/her right of access, modification, cancellation/removal, opposition, limitation or portability.
For that, he/she will need to contact our Customer Service through the contact form or WhatsApp.

Customer service hours: from Monday to Sunday, from 9:30am to 6:00pm.

 

8. LIABILITY & JURISDICTION

Both the access to the website as well as the non-consent use that may be undertaken from the information in such website is the responsibility of the person doing it. SASMAT RETAIL S.L. shall not be held responsible for any consequence, harm or damage that may result from this access or use of information. SASMAT RETAIL S.L. shall not be held responsible for any security error, that may be produced nor the harm caused to the IT system of the user (hardware and software), or to any folders or documents in such computer, as a consequence of:

  • Presence of a virus in the user's computer used to access the services and content of the website.
  • Browser malfunction.
  • And/or outdated versions of it.


SASMAT RETAIL S.L. will not be held responsible from the liability and speed of hyperlinks added in the website to direct to others. SASMAT RETAIL S.L. doesn't guarantee the usability of those links, and will not be held responsible from the contents or services to which the user may access through these links, nor the functioning of these websites.

SASMAT RETAIL S.L. will not be held responsible from the virus or other computer programs that damage or may damage the users' computer systems or equipment when accessing the website or other websites that may have been accessed from links in this website.

 

9. E-GIFT CARD CONDITIONS

9.1. PURCHASE

PDPAOLA e-Gift Cards can only be purchased on our website, pdpaola.com or at our PDPAOLA stores.

The customer can choose the value of the PDPAOLA e-Gift Card on its product page: from 50€ to 950€. Their use is exclusively restricted to purchases of PDPAOLA products.
It is not possible to add extra value on a PDPAOLA e-Gift Card after final purchase.

E-Gift cards can be paid through any of the payment methods accepted on the website or in stores. E-Gift Card cannot be paid with another gift card, discount codes or other promotional discounts.

All PDPAOLA Gift Cards are electronic, and will be sent by email to the chosen provided email address. No physical Gift Card can be sent to any postal address.

Important:

Buyers of e-Gift Cards have to make sure they provide the correct email address.

Recipients of e-Gift Cards have to make sure they keep the Gift Card email, as we are not able to provide any new PDPAOLA e-Gift Card in case the customer deletes it from their mailbox.

More than one e-Gift Card can be bought by order, repeating the “gift now” option process for as many receivers as wished. A unique Gift Card code will be sent by email to each recipient, and will not be visible in the order confirmation that the buyer receives, or by any other recipient.

The Gift Card code is sent by email to the recipient at the date the buyer has chosen on the e-Gift Card product page. That date can be different from the date of the purchase.
The e-Gift Card is activated on the selected date of receipt.

In order to process the purchase of an e-Gift Card, some personal information is required, such as: First Name, Last Name and email address.
This data will only be used for the purpose of the e-Gift Card management and will not be kept for any other purpose.

9.2. USE & VALIDITY IN TIME AND SPACE

PDPAOLA e-Gift Cards can be used on pdpaola.com and any of our PDPAOLA stores.

PDPAOLA e-Gift Cards can only be redeemed in euros (€).
To redeem a PDPAOLA e-Gift Card, the code received by email must be introduced at the checkout in the Order Summary section.

The e-Gift Card can be used as many times as wished until the balance for which it was issued is finished. If the purchase exceeds the import available in the e-Gift Card, is it possible to pay the difference with one of our payment options on our website.

Only one e-Gift Card can be used by purchase. However, it can be combined with a discount code and other payment methods among the ones we offer on our checkout.

The e-Gift Card balance can be consulted at any time by clicking on the link on the Gift Card email.

The PDPAOLA e-Gift Card expires 365 days after the date of reception of the email.

The PDPAOLA e-Gift Card can be purchased and redeemed in the following countries:
Austria, Bangladesh, Belgium, British Virgin Islands, Cyprus, Equatorial Guinea, Estonia, Finland, France, Germany, Greenland, Guinea-Bissau, Haiti, Iraq, Italy, Jersey, Latvia, Lithuania, Luxembourg, Mauritius, Monaco, Montenegro, New Zealand, Portugal, Singapore, Slovakia, Slovenia, Spain & Baleares Islands.

9.3. E-GIFT CARD SPECIFIC EXCHANGE AND RETURN CONDITIONS

The e-Gift Card is an electronic product, which only purpose is to be used as a payment method on a next purchase. Therefore, e-Gift Cards cannot be returned.

Exchange of an item purchased with an e-Gift Card: Items purchased with an e-Gift Card can only be exchanged, not refunded on credit card or any other payment method available on our checkout.

Return of an item purchased with an e-Gift Card: If the customer wishes to be refunded for the return of any product purchased with an e-Gift Card, our Customer Service will issue a new e-Gift Card as an after-sale solution.
If the customer returns an item partly purchased by e-Gift Card, the corresponding part will be paid back on a new e-Gift Card. The part corresponding to the Credit Card payment, or any other payment method, will be refunded the same way.

9.4 PRIVACY

In order to process the purchase of an e-Gift Card, some personal information is required, such as: First Name, Last Name and email address.

This data will only be used for the purpose of the e-Gift Card management and will not be kept for any other purpose.

9.5. LIABILITY OF THE E-GIFT CARD

The e-Gift Card issuer is SASMAT RETAIL SL, which is also the e-Gift Card's owner. The e-Gift Card is a bearer document. The responsibility for the use and custody of the e-Gift Card corresponds exclusively to its depositary or recipient.

The recipient of the e-Gift Card will be the only responsible party for its use and safekeeping.

PDPAOLA cannot be held responsible for the loss or cancellation of the e-Gift Card email, and therefore, no refund or creation of a new e-Gift Card can be issued.

The presentation of the purchase ticket from the buyer does not constitute a right for any refund or creation of a new e-Gift Card.

Unless prior written authorization from PDPAOLA, the e-Gift card may not be used for advertising or promotional purposes of products or services marketed by third parties outside of PDPAOLA.

In the event of acquiring an e-Gift Card, PDPAOLA is not responsible for non-receipt or delay in receiving it by its recipient for reasons beyond PDPAOLA's control, such as, among others: deficiencies in telecommunications lines, loss of information, inaccuracy of the data of the recipient of the e-Gift Card provided by the buyer of the same, inability to deliver the e-Gift Card to the email account provided by the buyer or the consideration of the email sent as spam.

 

This Notice will be interpreted and governed in accordance with the laws of Spain. SASMAT RETAIL S.L. and the users, are to expressly forego any other forum which may correspond to them, are subject themselves to the Tribunals and Courts of the user physical address for any controversy lead from the access or use of the website. In case the user's physical address is outside Spain, SASMAT RETAIL S.L. and the user, submit, expressly foregoing any other forum, to the Tribunals and Courts of the offices in Barcelona.
